TERMS OF SERVICE
THESE TERMS & CONDITIONS WILL APPLY TO THE PURCHASE OF SERVICES AND GOODS BY YOU (THE CUSTOMER)
INTERPRETATION

THE SUPPLIER

THE CUSTOMER
The person or person(s) booking services via ShineBooth for their event.

THIRD PARTY
Any guest, attendee or person present at the Customer's event.

CAPTURE(S)
Any media including photos, GIFs, boomerangs and video obtained through the photobooth or other ShineBooth media equipment.

EVENT
Any planned social occasion for which a photobooth booking has, or is yet to have been, made.

FAIR WEAR & TEAR
The deterioration of the Supplier's equipment due to age or that which would be reasonably expected over the course of an event, that is not due to The Customer's actions or omissions.
The following contract and its terms comprise an agreement between the Supplier and the Customer for the hire of the photobooth and any other services supplied by ShineBooth.
These Terms & Conditions set out in full the intentions of the involved parties and supersede any previous written or oral agreements made between the parties.
SERVICE PERIOD
The Supplier agrees to provide a photobooth that is operational and available for use for a minimum of 80% of the agreed service period.
PAYMENT
A non-refundable deposit of £50.00 from the total agreed rental charge is required to secure a reservation for the photobooth, with the balance of the agreed rental charge due no later than 24 hours before the Customer’s event - unless in cases where exceptional terms have been agreed between the Customer and the Supplier.
REFUNDS
In the event that it is not possible to provide an operational photobooth for a minimum of 80% of the agreed service period due to reasons within the Supplier's control, the Supplier shall make a refund to the Customer calculated pro rata from the total charge made for the agreed service period.
Where the rental includes a printer and for any reason printed photographs cannot be provided on site at the time of the event, the Supplier will refund the amount paid by the Customer for this specific service (printed photographs).
In the case of any act of nature, vehicle breakdown or any other act out of the Supplier's control that prevents ShineBooth from providing a photobooth (or other service) for the agreed service period, then a partial refund will be made to the Customer - excluding the non-refundable deposit of £50.00.
If no service is provided by the Supplier, the Supplier's maximum liability will be a full refund to the Customer. The Supplier is not responsible for any resulting damages or lost opportunities upon breach of this agreement.
ACCESS, SPACE & POWER REQUIREMENTS
The Customer must arrange for an appropriate space to be made available for the photobooth at the event venue, of at least 2m x 2m.
The Customer will also provide a mains electricity supply located within reasonable distance of the designated space for the photobooth.
DATE CHANGES & CANCELLATIONS
Any change of date is subject to the availability of the photobooth on the alternative date requested and will be agreed at the discretion of the supplier, ShineBooth.
Any request to alter the agreed date of a photobooth booking must be made in writing and at least 7 days prior to the Customer’s event.
If the Customer cancels an agreed rental of the photobooth following full payment within 7 days of the agreed hire date the full amount will be forfeit.
If the Customer cancels an agreed rental of the photobooth following full payment in advance of 7 days of the rental date, the Customer is entitled to a refund excluding the non-refundable deposit of £50.00.
LOSS OR DAMAGE TO THE SUPPLIER'S EQUIPMENT
The Customer assumes complete responsibility for any loss of or damage to the Supplier’s equipment - other than Fair Wear & Tear - caused by any misuse of the equipment by the Customer, their employees and/or any Third Party.
The Customer shall be responsible for any loss of or damage to the Supplier’s equipment caused by Theft, Fire, Flood or Accidental Damage during the agreed rental period at the hire venue.
INDEMNIFICATION
The Customer agrees to, and understands the following:

The Customer will indemnify the Supplier against any and all liability associated with the Customer’s event and use of the Supplier’s equipment.

The Customer will indemnify the Supplier against any and all liability related to the use of any Captures taken at the Customer’s event by the photobooth or by its operatives, employees or affiliates.
THE CUSTOMER AGREES TO & UNDERSTANDS THE FOLLOWING:
All person(s) using the photobooth at the Customer’s event grant ShineBooth permission to copyright and to use any Captures obtained by the Supplier of any photobooth user and/or guests at any time for promotion, advertising, or for any other purpose.
In addition, the Customer agrees to maintain ShineBooth free from any liability arising out of the taking of Captures at the event or any subsequent processing or publication therefrom including any claims for misrepresentation, defamation or invasion of privacy.
ShineBooth retains all copyright of Captures taken at the photobooth.
LIMITATIONS
In no event shall the Supplier be liable for any damages (i.e, damages for loss of data or profit, or arising from business interruption) due to the use or inability to use any Captures on the Customer's website and/or other platforms. The Customer has the right to use their event captures for personal and commercial purposes.
ADDITIONAL TERMS
Should any section of these terms be deemed unenforceable for any reason, then that section shall be deemed separate from the rest of this contract and will not affect the enforceability of any of the remaining sections.
This is the full agreement between the Supplier and the Customer relating to the Terms and Conditions of service. This agreement shall not be modified unless agreed by both parties in writing.
